Common sales terms

1. Acceptance of Terms

The customer acknowledges having read, at the time of ordering, the special conditions of sale stated on this screen and expressly accept them without reservation. These common sales terms govern the contractual relationship between Cobra-Sales and its client, the two parties accepting them without reservation. These common sales terms prevail over all other conditions contained in any other document, unless prior express written consent.

2. Products

The photographs illustrating the products are not contractual. If errors occur, shall in no case our responsibility be engaged. The majority of products offered to its customers are available on our premises.

3. Orders

The automatic registration systems are considered as proof of the nature, content and date of the order. We confirms the acceptance of purchase order to the customer to the email address he has given. The sale will be concluded only after the confirmation of the order. We reserve the right to cancel any order placed by a customer with whom there is a dispute over payment of a previous order or doubt on the relevance of information provided by alleged customers. The information given by the buyer when making an order is this : if error in the recipient's details, the seller can not be held responsible for failure in which it could be to deliver the product. We reserves the right not to confirm an order for any reason whatsoever : problem with respect to the order received, a problem of supply of one or more products, predictable problem with respect to delivery, technical problem. The customer would be contacted by phone, mail or email.

4. Shipping

After confirming the order, we will ship all items ordered by the buyer, subject to availability. The carrier, Bpost, undertakes by contract to deliver the order to the buyer's address within a non guaranteed delay of 1 business day in Belgium, 2 to 4 business days in Europe, 3 to 8 business days in the world. The delivery time is 1 business days (average time) for all items in stock. All orders placed are intended for personal use by customers. We cannot be held responsible from legal liability if the acquittal of taxes was not made by the client. The possible delays do not entitle the buyer to claim damages. In case of defects, the buyer has the right of return as provided in this document. The goods always travel at the risk of the recipient. Always check your package upon arrival. You have a period of 48 hours to file a claim with the carrier in case of missing or damaged. The customer only pays for one delivery. If the client wishes 2 places of delivery, he makes two orders, with delivery charge.

5. Return Policy

You have 14 days (counting from receipt date) to form an opinion. In case of exchange or refund request, the item(s) should be shipped back in their original packaging, unopened, undamaged, with all the accessories, user manuals and documentation within 14 days from your decision to retract. Shipping cost are buyer's charge. Upon exercise of the right of withdrawal, we will refund the amount paid by the client, except for actual shipping costs if they were fully covered by us. Refund is due within a maximum delay of 14 business days.

6. Price

All prices are quoted in euros. The price on the product description does not include shipping. The price listed in the order confirmation is the final price, including all taxes. This price includes the price of products, handling, packaging and storage products.

7. Payment

The price charged to the customer is the price indicated on the order confirmation sent by us. The product price is payable the day of the order. PayPal is an authorized retailer of goods and services supplied by Cobra-Sales. PayPal will appear on your card statement. We do not store credit card details nor do we share customer details with any 3rd parties. The order validated by the customer will be considered effective only when the payment platform have given their consent. In case of refusal of payment, the order will be canceled and the customer notified by email. In addition, we reserves the right to refuse any order from a customer with whom there is a dispute.

8. Litigation

We can not be held liable for damages of any kind, whether tangible or intangible property, which could result from a malfunction or improper use of products sold. It is the same for any changes resulting from product manufacturers. Our responsibility will in any event, limited to the amount of the order and can not be blamed for simple errors or omissions that may occur despite all precautions taken in presenting the products. In case of difficulties in implementing this contract, the buyer has the option, before any legal action to seek an amicable solution with the help of a professional association for the industry, a consumer association or any other counsel of his choice. It is recalled that the search for an amicable solution does not interrupts the "short period" of the legal warranty, nor the duration of the warranty contract. It is recalled that in general and subject to the discretion of the Courts, the provisions of this contract relating to the guarantee contract that requires the buyer to honour its financial commitments to the seller. Claims or disputes will always be received with attentive benevolence, good faith is always presumed in those who took the trouble to explain his situation. In case of dispute, the customer should first contact us for an amicable solution. Under legal age lack the capacity to contract. Anyone ordering on the site, therefore committed to be an adult.

9. Warranties

We guarantees that all products are carefully selected and controlled. In all cases we can not be held responsible for non-compliance with regulations and laws in force in the receiving country, our responsibility is always limited to the value of the product in question, value date of sale, and with no possibility of appeal to the brand or company producing the product. In any event, the client receives the legal guarantee on eviction and hidden defects. Provided that the purchaser makes the proof of the hidden defect, the seller is legally obliged to repair all the consequences, if the buyer goes to court, it must do so "promptly" after the discovery of the hidden defect.

10. Legal Information

Intelligence information collected for purposes of distance selling is required, this information is essential for processing and delivery orders, preparing invoices and warranty contracts. Lack of information leads to the non-confirmation of the order. We do not store credit card details nor do we share customer details with any 3rd parties.
